Q: What is the difference between unsecured and secured loans/debt? Are both types eligible for a debt settlement program? A: Secured loans or secured debt is borrowed money that uses an asset such as your home, your car, or some other tangible item as collateral. The assets used for a secured loan are a guarantee to your creditor that in the event you cannot repay the debt amount, the creditor or lender may repossess and sell off the asset in order to reduce the amount you owe. If the property or item is sold, you will still owe and be liable for the difference between what the item sold for and the remaining balance. An unsecured loan or debt does not have any collateral attached. If you fail to pay back an unsecured debt the lender or creditor can threaten to take legal action or hire a collection agency to attempt to collect what you owe. Unsecured debts include credit card bills, medical bills and personal loans as an example. Most unsecured debt can be included in a debt settlement plan whereas secured loans/debt cannot be included. Q: How do I know a debt settlement firm is legitimate? A: As with any business you are potentially choosing to work with, do the research on a debt settlement law firm or company to confirm they are reputable before proceeding. An internet search of the firm name will provide you with information and reviews regarding the firm’s track record including testimonials from satisfied clients and ratings from organizations such as the Better Business Bureau (BBB) which serve to legitimize and establish credibility as debt settlement service providers. You can also check with the BBB by visiting their website and the state bar to confirm the firm is licensed in your state. Since lawyers must comply with all laws regarding debt settlement and adhere to strict bar association and legal ethics rules as well, a law firm typically provides an extra layer of consumer protection should you choose to go with us over a regular debt settlement company. Q: Can I do debt settlement and loan modification at the same time? A: It is possible for a consumer to be working on a debt settlement plan and loan modification concurrently. Debt Settlement is the legal process of negotiating unsecured debt with creditors with the goal of reducing monthly payments and decreasing the amount of time it would take to pay off the total debt. Loan modification involves modifying or changing the terms of your mortgage loan to lower mortgage payments and potentially, to help many homeowners avoid foreclosure.. A mortgage loan is considered a secured loan and thus cannot be included in a debt settlement. Qualified debt settlement attorneys and loan modification lawyers are experienced negotiators and are knowledgeable concerning the latest laws that protect your rights. Q: Does a debt settlement hurt your credit or help? A: Being in debt can hurt your credit. Through debt settlement, you should be able to resolve your debts and ultimately have your credit report marked “settled in full” or the like. As a law firm handling debt settlement, should any creditors or debt collectors violate the Fair Debt Collection Practices Act or other consumer protection laws in an attempt to collect past due monies owed during this time, we can assist in getting the calls or letters to stop. Eventually, and with continued on time payments over many years, it is possible to bring credit up to an optimum level.
